Ownership

All simulations, their underlying logic, equations, code, graphics, and interface designs are the intellectual property of top5fella and protected by copyright law. You do not own or have rights to these materials.

Restrictions on Use

You may NOT:

• Reverse-engineer, decompile, or attempt to extract the simulation logic, equations, or code.
• Scrape, crawl, or automate access to the Site or simulations.
• Redistribute, resell, or republish any simulation or its output.
• Use our simulations to create competing products or services.
• Remove, obscure, or alter any copyright or proprietary notice.

Violation of these restrictions may result in account suspension and legal action.

Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Site and simulations for your personal, non-commercial educational use only. This license does not permit commercial use, modification, or redistribution.

Subscription Plans

top5fella offers the following tiers:

• Free: 22 of 43 simulations, 50 lifetime runs (one-time, never reset), PNG snapshot export.
• Launch: $5/month, 200 runs per month, 30 of 43 simulations, video export at 480p (watermarked).
• Orbit: $9/month, 1000 runs per month, 37 of 43 simulations, video export at 1080p (watermarked), live interactive labs.
• Interstellar (Standard): $18/month, unlimited runs (fair-use limits apply), all 43 simulations, 4K video export, watermark-free exports.
• Interstellar (Edu): $10/month (for verified .edu email), same entitlements as Interstellar (Standard).

Current plan details and entitlements are listed on the pricing page and may be updated from time to time; continued use of the Site after a change constitutes acceptance of the updated plan.

Runs & Credits

One "run" = one simulation session. Each session includes a free 2-minute re-run window (play/pause/scrub/replay without additional charge). Paid tiers reset their monthly run allowance at the start of each billing cycle. Runs do not roll over to the next month. Free-tier users have exactly 50 lifetime runs, tied to their account; switching from paid to free does not grant new free runs.

Fair Use (Unlimited Tier)

The Interstellar "unlimited" tier is intended for ordinary interactive use by one person. To prevent scripted abuse, simulation runs are rate-limited to 20 runs per minute per account — far above normal interactive use, and low enough to stop automated bulk extraction.

We may introduce further reasonable fair-use limits (for example a daily cap) if needed to keep the service running well for everyone. If we do, we will update this page, and the limits will remain generous enough that ordinary use is unaffected.

These limits apply to all users. Accounts detected running automated, bulk, or scripted simulations are subject to suspension under the Acceptable Use Policy.

Automatic Renewal & Cancellation

Paid subscriptions renew automatically each month until you cancel. Stripe will charge your payment method the then-current price for your tier at the start of each billing period. You may cancel at any time from your account via "Manage billing" — no notice period, and no cancellation fee. When you cancel, your plan stays active until the end of the billing period you have already paid for, and is not renewed after that.

We will give you reasonable advance notice before any increase to the price of your tier takes effect, so that you can cancel beforehand if you do not wish to continue.

Refunds

Nothing in this section limits your rights under the Australian Consumer Law. Our services come with consumer guarantees that cannot be excluded. If there is a major failure with the service, you are entitled to cancel your subscription and to a refund for the unused portion, or to compensation for any other reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the problem fixed within a reasonable time, and if that is not done, to cancel and obtain a refund for the unused portion.

What we treat as a major failure. Whether a failure is major is decided by the Australian Consumer Law, not by us, and nothing here changes that. So that you know in advance how we apply it to a digital subscription: we would treat it as a major failure if the Site were unavailable for a sustained period during your billing month, or if a feature you pay for did not work at all and we could not fix it within a reasonable time. We would treat it as a minor problem, which we will fix within a reasonable time, if a single simulation has a bug or an inaccuracy, if a result differs from what you expected, if there is a cosmetic or display issue, or if the Site is briefly unavailable for maintenance or an incident that is resolved promptly. Because the simulations are teaching illustrations (see Section 2), a simulation showing a simplified or exaggerated version of a real effect is how it is designed to work, not a failure.

Outside of those rights, subscription charges are generally non-refundable: we do not offer partial refunds, credits, or compensation for unused runs simply because a plan went unused. When we assess a refund request we may take into account how much of the service was used before the request was made. Payment Processing

Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method for the selected tier on a recurring monthly basis. You agree to keep your payment information current. Failure to pay may result in service interruption or account suspension.

All prices are shown in US dollars. top5fella is not currently registered for GST, so no GST is charged on Australian purchases and the price you see is the price you pay. If we become required to collect GST or any other tax in your jurisdiction, that amount will be shown at checkout before you confirm payment.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access or breach. We are not liable for unauthorized use of your account.

Acceptable Use Policy

You agree NOT to:

• Violate any laws or regulations.
• Attempt to gain unauthorized access to the Site or other users' accounts (hacking, cracking, etc.).
• Use the Site for automated, bulk, or scripted purposes (bots, crawlers, unless explicitly permitted).
• Harass, threaten, defame, or abuse others via the Site.
• Create multiple accounts to circumvent quotas, fair-use limits, or payment obligations.
• Reverse-engineer, decompile, or attempt to extract proprietary logic (covered in Section 3).
• Disrupt the Site's availability or performance.
• Engage in any other conduct that violates these terms or is harmful to top5fella or other users.

Consequences of Violation

We may, at our sole discretion:

• Suspend or terminate your account immediately.
• Pursue legal action for breach of contract, IP infringement, or other violations.
• Report suspected payment fraud to our payment processor and, where required, to law enforcement.
• Restrict your access to the Site and all future accounts tied to you.

As-Is Disclaimer

To the extent permitted by law, the Site and all simulations are provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

Nothing in this Section 7 excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can lawfully be limited, it is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

No Accuracy Guarantee

While we strive for accuracy, we make no guarantee that the simulations are error-free or suitable for purposes beyond education. You use the simulations entirely at your own risk.

Limitation of Liability

To the maximum extent permitted by law, top5fella will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages.
